Terms & License Conditions

1. Scope

These terms govern the use of the macOS application "Vibalos" (the "Software"). The provider of the Software is:

By purchasing and/or using the Software, you accept these terms.

2. Contract partner and sale

The Software is sold via Lemonsqueezy (Lemon Squeezy LLC, USA). Lemonsqueezy acts as the "Merchant of Record" and is therefore your contract partner for the payment process, including VAT collection, invoicing, and payment handling.

The Lemonsqueezy Terms of Service and Refund Policy apply additionally.

The terms here govern the use of the Software, not the payment transaction.

3. License grant

Upon purchase, you receive a simple, non-exclusive, non-transferable license to use the Software on one (1) Mac that you own or regularly use.

The license is perpetual ("lifetime") — for as long as the Software remains technically functional and supported by updates.

The free trial covers 50 polish operations. After that, an active license is required to continue using polish features. Pasteboard, Snap and onboarding functions remain usable without a license (subject to change).

4. Use restrictions

You may not:

• resell, transfer, rent, or sublicense the Software or your license key;
• install the Software on more Macs than your license permits;
• decompile, disassemble, or reverse-engineer the Software, except where mandatory law expressly permits;
• circumvent license checks or other technical protection measures;
• use the Software in a manner that violates applicable law.

5. Updates and support

Vibalos is actively developed by the provider. You receive free updates via the built-in update mechanism (Sparkle) for as long as the Software is maintained.

There is no entitlement to specific future features, update frequencies, or a minimum maintenance period. If maintenance ends, you keep the most recently purchased version.

Support is provided primarily via the public GitHub repository github.com/moinsen-dev/vibalos and on request by email. There is no legal entitlement to support within specific response times.

6. Right of withdrawal / refunds

As a consumer in the EU, you generally have a 14-day right of withdrawal when purchasing digital content.

Since the Software is delivered digitally immediately after purchase, the right of withdrawal expires as soon as you activate the license or download the Software — provided you expressly consented to this process at checkout. Lemonsqueezy collects this consent during the checkout process.

Independently, Lemonsqueezy offers a 14-day refund policy at its own discretion. Refunds are processed directly through Lemonsqueezy: contact business@moinsen.dev for requests.

7. Warranty and liability

The Software is provided "as is". No warranty is given that it meets specific requirements, is compatible with all Mac configurations, or runs error-free.

The provider's liability is limited to intent and gross negligence. For slight negligence, the provider is liable only for breach of essential contractual obligations, and then only up to the foreseeable typical damage.

This limitation does not apply to damages from injury to life, body, or health, or to claims under the Product Liability Act.

8. Data processing

Vibalos processes your text, prompts, and screenshots exclusively locally on your Mac. No cloud upload, no telemetry.

During purchase, your email address and payment data are sent to Lemonsqueezy; a signed license file is then emailed to you. License verification within the app is performed offline.

9. Applicable law and jurisdiction

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory law of the consumer's country of residence remains unaffected.

Where legally permitted, the place of jurisdiction is Hamburg.

10. Final provisions

Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.

Changes to these terms will be published at vibalos.moinsen.dev/en/terms. The terms in effect at the time of purchase apply to the respective contract.

Online dispute resolution: the European Commission provides a platform at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration body.
